The judgment of the Supreme Court of Virginia is vacated and the case is remanded for further proceedings not inconsistent with Miller v. California, 413 U.S. 15, at 23?25, 93 S.Ct. 2607, at 2614?2615, 37 L.Ed.2d 419 (1973); Paris Adult Theatre I v. Slayton, 413 U.S. 49, at 58, 93 S.Ct. 2628, at 2635, 37 L.Ed.2d 446, n. 7 (1973); and Heller v. New York, 413 U.S. 483, 93 S.Ct. 2789, 37 L.Ed.2d 745 (1973). See United States v. 12 200-Ft. Reels of Super 8mm. Film, 413 U.S. 123, at 129?130 and n. 7, 93 S.Ct. 2665, at 2669?2670, 37 L.Ed.2d 500 (1973). A trial by jury is not constitutionally required in this state civil proceeding pursuant to ? 18.1?236.3 of the Code of Virginia, 1950, as amended. See Melancon v. McKeithen, 345 F.Supp. 1025, 1027, 1035?1045, 1048 (ED La.), aff’d sub nom. Mayes v. Ellis, 409 U.S. 943, 93 S.Ct. 289, 34 L.Ed.2d 214 (1972), and Hill v.
