This case, like Endicott-Johnson Corporation v. Encyclopedia Press, Inc. (No. 41), 266 U. S. 285, 45 S. Ct. 61, 69 L. Ed. ——, just decided, involves the constitutional validity of section 1391 of the New York Code of Civil Procedure. Smith v. Endicott-Johnson Corporation (Sup.) 189 N. Y. S. 673; Id., 199 App. Div. 194, 192 N. Y. S. 121; Id., 234 N. Y. 628, 138 N. E. 474. It is in all respects similar to the Encyclopedia Press Case and governed by the decision therein.
The judgment is
