Can An Older Minor Be Charged With Statutory Rape?

Let’s say that a 17 year old male has sex with a 14 year old female. Now, since the 17 year old is still a minor and not an adult yet is he free from statutory rape charge?

Depends ENTIRELY on State law, and you didn’t tell us where you are.
Being a minor does not, in itself, make you immune from criminal charges for having sex with someone under the age of consent.
However, many States have “close in age” exceptions under which one cannot be prosecuted for having sex with someone who is under the age of consent but less than a certain age younger.

He can and SHOULD be charged with stautory rape.
There’s a famous case in FL where the two kids had consensual sex, but the boy went to prison for seven years.

if she says no you are and plus why would you want to mess up a fourteen year Old life when you both should be getting your education and prepare for a job to better your life. You should be more major then wanting to do such. Don’t if you do then your life will change for the worse.

ok if the 17 year old and 14 year old both agree to have sex then that not statutory rape but if the 17 year old force the 14 year old to have sex then he would be charge for the crime but its all depends what states they both resides at.

Depends on the state’s law. But if 14 yr old were my daughter, Romeo would have far greater worries than what the courts might do.

Depends on the state what charges, if any, can be filed.
No, minors are not immune from rape charges, just like they are not immune from murder, theft, driving, etc. laws.
The question is did he violate his state law.
In the state I reside in, he could be brought in for statutory rape. This is not true in all states.

Well when i was 13 and i lost my virginity to a 16 year old it was consentual but my parents asked a cop about it and the cop said that it dont matter if you consent to it because the law states in ohio that you cant consent to something like that until you are 16 years old. Now im about to turn 18 and i think about how it is gross for guys my age to have sex with girls that are 13 and 14 because it takes there innocance away, really it does. So if its happening it needs to stop. and if your forcefully taking it, you need to be turned in because thats sick. Oh and if her parents decide to turn you in for statutory rape, then you will probably get charged with it because they still have say so over her. So good luck with that situation.

It depends on only one thing…does the prosecutor want to bring charges. The age of consent in every state is 16 or older (http://www.ageofconsent.us/ ), but the age of majority remains 18 (anyone under the age of majority is a minor). Therefore, sex by anyone of any age with someone who is under the age of 18 can be prosecuted for sex with a minor.
Believe what you want though, spin the wheel and take your chances so to speak.

Four years older ..but why be haivng sex at this age with a 14 year old in the first place..trouble is not good to go in that direction
